Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SnoutData account and billing website at snoutdata.com (the "Site") and the SnoutData desktop application (the "App"), together with the related authentication, billing, and AI features we provide (collectively, the "Service"). The Service is provided by Joel Oliver, operating as SnoutData ("SnoutData", "we", "us", or "our"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
SnoutData is a desktop database client with built in AI assistance. The Site lets you sign in, view your current plan, and buy, change, or cancel a paid plan. We offer three plans: Free, Plus, and Pro. The features included in each plan are described on the Site and may change over time as the product evolves.
We may modify, suspend, or discontinue any part of the Service at any time. We will try to give reasonable notice of material changes that adversely affect paid plans.
2. Accounts and sign in
You sign in using a third party identity provider (Google or GitHub). You are responsible for maintaining the security of the account you use to sign in and for all activity that occurs under your SnoutData account. The same account is shared between the Site and the App. You must provide accurate information and must be at least the age of majority in your jurisdiction, and in any case at least 16 years old, to use the Service.
3. Plans, billing, and renewal
The Free plan is provided at no charge. Paid plans (Plus and Pro) are sold as recurring monthly subscriptions. Current prices are shown on the Site (at the time of writing, Plus is 5 US dollars per month and Pro is 15 US dollars per month), exclusive of any taxes that may apply.
Payments are processed by Stripe. By purchasing a paid plan you authorize us, through Stripe, to charge your selected payment method on a recurring basis. Your subscription automatically renews each month and your payment method is charged at the start of each billing period until you cancel. You authorize these recurring charges without requiring our further approval for each charge.
We may change plan prices or the features included in a plan. Some AI features run on local models, while others rely on third party AI model providers whose token and usage prices change over time. We specifically reserve the right to adjust plan prices, AI quotas, or both, to reflect changes in those underlying third party provider costs and in our own costs of operating the Service. If we change the price of a plan you are subscribed to, we will give you advance notice, and the new price will apply to your next billing period after the notice. Your continued use of the paid plan after a price change takes effect constitutes acceptance of the new price. If you do not agree to a new price, you may cancel before it takes effect.
4. Cancellation
You can cancel a paid plan at any time through the Stripe customer portal, reachable from your account dashboard. When you cancel, your paid plan remains active until the end of the billing period you have already paid for, and it will not renew after that. At the end of that period your account reverts to the Free plan.
5. Refunds
Payments are generally non refundable, including for partial billing periods. Our refund practices are described in our Refund Policy at snoutdata.com/refunds, which forms part of these Terms.
6. Account deletion
You may permanently delete your account from your account dashboard. Deletion is irreversible. It removes your login identity, your plan record, and your synced application settings, and it cancels any active subscription immediately. Deleting your account does not entitle you to a refund of any amounts already paid. Certain records held by our payment processor (for example, historical invoices and payment records) are retained as described in our Privacy Policy and Refund Policy, because we are required to keep them for accounting, tax, and legal purposes.
7. Acceptable use
You agree not to:
- use the Service in violation of any applicable law or regulation;
- attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
- interfere with or disrupt the integrity or performance of the Service;
- abuse, overload, or attempt to circumvent the usage limits or quotas of the AI features, including by automated means; or
- use the Service to build a competing product by copying its hosted infrastructure or content.
We may suspend or terminate access for conduct that we reasonably believe violates these Terms.
8. AI features
The Service includes AI generated assistance. AI output can be inaccurate, incomplete, or misleading, and may not be suitable for your particular use. You are responsible for reviewing and validating any AI output before relying on it, especially for queries that modify data. AI features are subject to usage quotas that vary by plan, and may be rate limited or temporarily unavailable.
9. Intellectual property and your data
As between you and us, you retain all rights to the database content and queries you work with in the App. We do not claim ownership of your data. The SnoutData name, logo, Site, and Service are owned by us or our licensors and are protected by intellectual property laws. The App may be provided under a separate software license; nothing in these Terms grants you rights in our trademarks.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Service will be uninterrupted, error free, or secure, or that any AI output will be accurate.
11. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or 50 US dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. If a change is material, we will provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws rules. The courts located in the Province of Ontario, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer protection rights you may have in your country of residence.
